What is a Data Transfer and Use Agreement (DTUA)?
Data Transfer and Use Agreements (DTUAs) are binding contracts written to govern how data is shared/transferred from one party (a “Provider”) to another party (a “Recipient”). DTUAs define the terms and conditions of a data transfer, such as limitations on the use of the data, how the data is to be stored, and publication and privacy rights. The University of Nebraska-Lincoln (UNL) enters into DTUAs when UNL is either the provider or the recipient of the data.
Why and When Do You Need a DTUA?
Any time data is being transferred between UNL and an outside party (collaborator), a DTUA will most likely be necessary. Research and data owned by UNL must be shared in a manner that aligns with the best interests of university. Therefore, UNL’s Office of Sponsored Programs (OSP) needs to review potential DTUA requests and review all DTUA drafts.
The timeline for review and execution of a DTUA depends on the complexity of the request and the response time of the collaborator. For these reasons we encourage investigators to initiate the DTUA process as soon as possible. OSP will review all DTUA intake forms within 2-4 weeks of receipt.
Who Initiates the DTUA Process?
A Principal Investigator must initiate the DTUA process by filling out the DTUA intake form to notify OSP of the potential DTUA. All DTUAs must be either drafted or reviewed by the OSP Award Acceptance & Contract Negotiation team and signed by an authorized UNL official.
How do I Submit a DTUA Intake Form?
The DTUA Intake Form covers a variety of necessary background information about the research and data. The intake form includes the UNL investigator’s contact information, the collaborator’s contact information, project details, transfer details, compliance checks, and personnel details. A member of the OSP Award Acceptance & Contract Negotiation team may contact you with additional questions if necessary. A DTUA will most likely require OSP to consult with UNL Research Compliance to ensure all protocols are approved and in place.
